C Spire Terms of Use

Access to C Spire's Internet sites (collectively the "Sites"), is given to users ("User" or "you") subject to the Terms of Use stated herein ("Agreement"). The Sites include C Spire’s online communities, other communication tools, related links and downloads, games and/or entertainment, and or other content. Nothing in this Agreement shall be construed to modify any existing written or online agreements, policies or guidelines you may have with C Spire, including, but not limited to the User Guide and Customer Service Agreement.

By accessing, using, downloading, commenting or browsing on or from the Sites, you agree to be bound by this Agreement. C Spire reserves the right to amend or modify this Agreement and any modifications to same will be effective from the date of posting of such amendments or modifications on the Sites. By continuing to use the Sites after any modification, you consent to such changes.

The Sites are intended for users who are thirteen (13) years of age and older. C Spire does not knowingly collect personal information from children under the thirteen (13) years of age. If C Spire learns that a child under thirteen (13) years of age has submitted personal information to C Spire, C Spire will delete such personal information as soon as possible.

In the event you elect to register on the Sites by submitting your name, user name, password and/or email address, you warrant and represent that you are over thirteen (13) years of age. If you are at least thirteen (13) years of age but under eighteen (18) years of age and in the event you elect to register on the Sites by submitting your name, user name, password and/or email address, you warrant and represent you have been given consent to do so by your parent or legal guardian, and that you are fully competent to enter into the terms of this Agreement. If you have not been given such permission, you should leave the Sites now.

You are solely responsible for your use of the Sites and/or the content provided by you or accessed by you on the Sites, including the consequences of such use, such as the use of content provided by you by third parties. In addition, it is your sole responsibility to ensure the confidentiality of your name, user name, password and/or email address. You further agree to accept responsibility for any actions taken under your name, user name, password and/or email address, and you understand that C Spire may use or rely upon any action taken under your name, user name, password and/or email address. C Spire shall not be liable to you or any third party for any actions arising out of or resulting from any unauthorized use of your name, user name, password and/or email address, or any action or failure to act by C Spire under this provision.

C Spire is under no obligation to monitor the content of the Sites or any other information transmitted to the Sites. C Spire does not guarantee, endorse or advocate the statements, personal views or the content of any content uploaded by its users, regardless of the originator of such content. Moreover, C Spire will assume no responsibility for any content on the Sites that may be considered to violate applicable trademark and copyright laws; lewd, indecent, harassing, threatening, defamatory, disparaging, obscene, sensitive, confidential, personal or otherwise inappropriate or objectionable comments, postings, materials or other content; to violate of any applicable state or federal laws, or that a third party could otherwise rely upon to their detriment. Nevertheless, C Spire reserves the right to exercise its sole discretion to: (a) limit or terminate your access or ability to post comments or other content to the Sites, and (b) delete or edit any messages, comments, or other content or materials posted by you for any reason or no reason at all, including but not limited to, your failure to comply with the Acceptable Use Policy. C Spire shall not be responsible for any delay or failure to remove or otherwise edit materials posted by users to the Sites. Further, C Spire reserves the right to take any action it deems necessary, in its sole judgment and discretion, to enforce this Agreement or any other agreement you may have with C Spire. You agree and understand that you shall bear the risk of any content supplied by you and that C Spire shall not be liable or otherwise responsible for same.

You grant C Spire a royalty-free license and right to use, modify, adapt, reproduce, republish, distribute, or display any information, including, but not limited to, content, comments, postings, materials, ideas, tips, or suggestions provided by you, whether by email, comment or post, in its sole discretion and without compensation to you. You further grant C Spire the right to use your name in connection with such above-described uses. You agree that this license includes the right for C Spire to make any such content available to other third parties for their broadcast, publication, distribution or use.

The Privacy Policy cspire.com/privacypolicy details C Spire's use and collection of information from you in connection with the use of our Sites. Where applicable, your participation in certain offerings on the Sites may lead to C Spire's collection of information from you; however, C Spire will inform you in the terms and conditions of such offerings prior to your agreement to participate in same.

The C Spire Sites may at times provide you a link or otherwise allow you to download and use content, including, but not limited to, ringtones, games, tools or other information (collectively "Apps") to a compatible wireless device. Users of Apps may also be subject to other terms by parties not affiliated with C Spire, and the terms of service associated with such Apps. You agree that C Spire is not responsible for your compliance with such terms. You shall be responsible for any and all charges incurred for the App until the App is removed from your account, despite whether you have lost or otherwise replaced your device. You agree that you will only use Apps on the device in which they are downloaded. You further acknowledge that no transfers, credits or refunds on the Apps are permitted.

No license is granted to you with respect to the Apps, and you have no intellectual property or other rights in the Apps, including, but not limited to, in any copyrights, trade secrets, trademarks, or patents. You agree not to decompile, disassemble or modify the Apps. You shall not remove or obscure any copyright or other proprietary notices from the Apps. No license is granted to assign, copy, reproduce, sublicense, transfer or otherwise exploit the Apps. You agree that the owners and developers of each App retain all interests and rights in and to the Apps and all copies of the Apps. You further agree that the owners and developers retain all interests and rights to the copyrights in the Apps.

THE SITES ARE PROVIDED TO YOU "AS IS." C SPIRE DISCLAIMS ANY AND ALL WARRANTIES RELATED TO THE SITES AND ANY MATERIAL OR CONTENT UPLOADED, DOWNLOADED OR OTHERWISE OBTAINED BY YOU, INCLUDING THE APPS, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. C SPIRE FURTHER DISCLAIMS ANY WARRANTIES CONCERNING WHETHER THE SITES OR APPS OPERATE PROPERLY OR IN CONJUNCTION WITH YOUR DEVICE AND/OR ANY HARDWARE OR SOFTWARE, OR OTHER REQUIREMENTS YOU MAY HAVE. C SPIRE FURTHER DISCLAIMS ANY WARRANTY THAT THE SITES OR APPS WILL OPERATE ERROR-FREE OR ON AN UNINTERRUPTED BASIS. SOME STATES DO NOT ALLOW THE ABOVE LIMITATIONS OF LIABILITY, SO THE ABOVE EXCLUSION MAY NOT APPLY. C SPIRE MAY ALSO HAVE OTHER LEGAL RIGHTS WHICH VARY FROM STATE TO STATE.

C SPIRE SHALL HAVE NO LIABILITY OR OBLIGATION IN EITHER CONTRACT OR TORT, FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND INCURRED BY YOU, SUCH AS, BUT NOT LIMITED TO, CLAIMS FOR DAMAGES FOR PERSONAL INJURY, WRONGFUL DEATH, LOSS OF USE, LOSS OF ANTICIPATED PROFITS, LOST DATA OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES OR ECONOMIC LOSSES OF ANY KIND, ARISING OUT OF THE DOWNLOAD, INSTALLATION AND/OR USE OF THE SITES, CONTENT ON THE SITES OR ACCESSIBLE THROUGH THE SITES, THE APPS, THE ACTS OR OMISSIONS OF ANY THIRD PARTY, OR FOR ANY CONTENT PROVIDED BY ANY THIRD PARTY, IRRESPECTIVE OF WHETHER C SPIRE HAS BEEN NOTIFIED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER OR NOT CAUSED BY C SPIRE'S NEGLIGENCE, TO THE FULL EXTENT SAME MAY BE DISCLAIMED BY LAW. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSION MAY NOT APPLY. C SPIRE MAY ALSO HAVE OTHER LEGAL RIGHTS WHICH VARY FROM STATE TO STATE.

You agree to indemnify, defend and hold harmless C Spire, its shareholders, and each of their employees, directors, officers, agents, business partners, subsidiaries, affiliates, contractors, and representatives from and against any and all third party claims, demands, liabilities, costs or expenses, including attorneys' fees and costs, arising out of, or related to, any breach by you of any term of this Agreement or applicable law, your use of Sites and/or your downloading or use of any App, including, but not limited to, due to any posting of comments, materials or other content by you.

ARBITRATION: YOU AGREE THAT ANY CONTROVERSIES, CLAIMS OR DISPUTES ARISING BETWEEN YOU AND C SPIRE, WHETHER IN TORT OR IN CONTRACT, INCLUDING BUT NOT LIMITED TO THOSE RELATED TO OR ARISING OUT OF THIS AGREEMENT, OR THE SERVICES PROVIDED, INCLUDING ACCESS AND/OR USE OF THE SITES AND/OR ANY APP, WHETHER ARISING BEFORE OR AFTER THE EFFECTIVE DATE OF THIS AGREEMENT, MUST BE RESOLVED BY FINAL AND BINDING ARBITRATION. THIS INCLUDES ANY AND ALL DISPUTES BASED ON ANY PRODUCT, SERVICE OR ADVERTISING PROVIDED BY C SPIRE, INCLUDING, BUT NOT LIMITED TO, ACCESS AND/OR USE OF THE SITES AND APPS. SUCH ARBITRATION SHALL BE BEFORE A PANEL CONSISTING OF THREE ARBITRATORS AT A LOCATION IN THE GREATER JACKSON, MISSISSIPPI METROPOLITAN AREA. SUCH ARBITRATION SHALL BE BINDING UPON BOTH YOU AND C SPIRE AND SHALL BE CONDUCTED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") UNDER ITS RULES, INCLUDING THE SELECTION OF THE ARBITRATORS, WHICH SHALL BE ACCOMPLISHED IN ACCORDANCE WITH THE RULES OF THE AAA. THE AWARD RENDERED BY THE ARBITRATORS SHALL BE FINAL, AND JUDGMENT MAY BE ENTERED UPON IT IN ACCORDANCE WITH APPLICABLE LAW IN ANY COURT HAVING JURISDICTION THEREOF. THE PARTIES FURTHER AGREE THAT THE PREVAILING PARTY IN SUCH ARBITRATION SHALL BE ENTITLED TO RECOVER THE COSTS OF SUCH ARBITRATION FROM THE OTHER PARTY, INCLUDING, BUT NOT LIMITED TO, REASONABLE ATTORNEYS' FEES. THIS AGREEMENT TO ARBITRATE SHALL BE SPECIFICALLY ENFORCEABLE UNDER APPLICABLE LAW IN ANY COURT HAVING JURISDICTION THEREOF. PROVIDED, HOWEVER, COLLECTION MATTERS OF $1,500 OR LESS IN ALLEGED VALUE (BEFORE COSTS, INTEREST AND ALLOWABLE ATTORNEYS' FEES, IF ANY) FOR SERVICE MAY BE FILED IN ANY COURT WITH JURISDICTION THEREOVER AND THERE TRIED BY ANY PARTY, UNLESS COUNTER-CLAIMS OR OTHER CLAIMS IN AN AMOUNT IN EXCESS OF $1,500 (SUBJECT TO THE SAME EXCLUSIONS) ARE ASSERTED BY ANY PARTY. IN THE LATTER CASE, THE ENTIRE MATTER AND ALL CLAIMS BEFORE THE COURT SHALL BECOME SUBJECT TO BINDING ARBITRATION HEREUNDER UPON WRITTEN REQUEST OF ANY PARTY FILED WITH THE COURT WITHIN THIRTY (30) CALENDAR DAYS OF ACTUAL NOTICE OF THE FILING OF SUCH COUNTER-CLAIMS OR OTHER CLAIMS.

This Agreement and your use of the Sites shall be governed by and construed in accordance with the substantive laws of the State of Mississippi, without regard to the principles of conflicts of law thereof.

 

ACCEPTABLE USE POLICY

You agree that your use of the Sites (whether or not authorized by you) will not violate the Acceptable Use Policy as set forth below, or any other terms or agreement you have with C Spire. C Spire reserves the right to exercise its sole discretion to: (a) limit or terminate your access or ability to post comments or other content to the Sites, and/or (b) delete or edit any messages, comments, or other content or materials posted by you for any reason or no reason at all, including but not limited to the following actions by you:

  1. Violation of applicable trademark and copyright laws;
  2. Lewd, indecent, harassing, threatening, defamatory, disparaging, obscene, sensitive, confidential, personal, deceptive, fraudulent or otherwise inappropriate or objectionable comments, postings, materials or other content;
  3. Attempts to promote, advertise or solicit;
  4. Attempts to tamper, interfere or disrupt the Sites in any manner;
  5. Attempts to reproduce or duplicate the Sites or any content thereof; and
  6. Violation of any applicable state or federal laws, or that a third party could otherwise rely upon to their detriment.

Please be aware of additional terms, conditions, restrictions, standards and/or guidelines that may be applicable to specific applications and offerings on the Sites, such as C Spire's community and social media applications. You agree to comply with these additional terms, conditions, restrictions, standards and/or guidelines.

 

NOTICE AND TAKE-DOWN POLICY

It is the policy of C Spire to expeditiously respond to clear notices of alleged copyright infringement. This page describes the information that should be present in these notices. C Spire designed this policy to make submitting notices of alleged infringement to C Spire as straightforward as possible while reducing the number of received notices that are fraudulent or difficult to understand or verify. The form of notice specified below is consistent with the form suggested by the United States Digital Millennium Copyright Act ("DMCA").

It is expected that all users of any part of the Sites will comply with applicable copyright laws. If, however, C Spire receives proper notification of claimed copyright infringement, the response to such notices will include removing or disabling access to content claimed to be the subject of infringing activity and/or terminating the user's account, regardless of whether C Spire may be liable for such infringement under United States laws, state or local laws, or the laws of another jurisdiction.

If C Spire removes or disables access in response to such a notice, C Spire will make a good-faith attempt to contact the owner of the affected content so that a counter notification pursuant to Sections 512(g)(2) and (3) of the DMCA may be made. C Spire may also document notices of alleged infringement on which it acts.

Upon receipt of proper notification of claimed infringement, C Spire will follow the procedures outlined herein and in the DMCA.

To file a notice of infringement with C Spire, provide a written communication by certified U.S. Mail, return receipt requested, that sets forth the information specified in the list below. Email notices will not be acceptable without prior written agreement. Please note that you will be liable for damages (including costs and attorney's fees) if you materially misrepresent that content is infringing your copyright(s). If you are not sure whether the content at issue infringes on your copyright, please consult an attorney.

To expedite the processing of your request, please use the following format (including section numbers):

(a) Identify with sufficient detail the copyrighted work that you believe has been infringed (for example, "The copyrighted work at issue is the "Name of the work" by "name of the artist" which is available at (http://______________)");
(b) Identify the content that you claim is infringing the copyrighted work listed above. Include identification of the content that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit C Spire to locate the content;
(c) Provide information reasonably sufficient to permit C Spire to contact the complaining party, such as an address, telephone number, and, if available, an email address at which the complaining party may be contacted;
(d) Make the following statement: "I have a good faith belief that use of the content in the manner complained of is not authorized by the copyright owner, its agent, or the law";
(e) Make the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate, and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed";

COUNTER NOTIFICATION

The provider of the allegedly infringing content may make a counter notification pursuant to sections 512(g)(2) and (3) of the DMCA.

To file a counter notification with C Spire, provide a written communication by certified or registered U.S. Mail, postage prepaid, return receipt requested, that sets forth the information specified in the list below. Email notices will not be acceptable without prior written agreement. Please note that you will be liable for damages (including costs and attorneys' fees) if you materially misrepresent that content is not infringing the copyrights of others. If you are not sure whether certain content infringes the copyrights of others, please consult an attorney.

To expedite the processing of your request, please use the following format (including section numbers):

(a) Identify the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or access to it was disabled;
(b) Provide your name, address, and telephone number;
(c) Make the following statement: "I consent to the jurisdiction of Federal District Court for the [insert the federal judicial district in which your address is located]";
(d) Make the following statement: "I will accept service of process from [insert the name of the person who submitted the infringement notification] or his/her agent";
(e) Make the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the affected material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled";

Upon receipt of such counter notification, C Spire will promptly provide the person who provided the original infringement notification with a copy of the counter notification, and inform that person that C Spire will replace the content or cease disabling access to it in 10 business days. C Spire will replace the removed material and cease disabling access to it not less than 10, nor more than 14, business days following receipt of the counter notice, unless C Spire's Designated Agent (identified above) first receives notice from the person who submitted the original infringement notification that such person has filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our system or network.

REPEAT INFRINGERS

In accordance with Section 512(i)(1)(a) of the DMCA, C Spire will, in appropriate circumstances, disable and/or terminate the accounts of users who are repeat infringers.

C Spire respects the privacy of its customers and is committed to protecting the privacy and security of your personal information. This Privacy Policy discloses and details the privacy practices of C Spire, including how C Spire will collect, use, distribute and safeguard your personal information.

 

PRIVACY POLICY

Effective Date: October 22, 2013

SCOPE

This Privacy Policy applies to C Spire's wireless services, websites, mobile and web-based applications and personalized service offerings (the "Sites"). This privacy statement describes how C Spire collects and uses the personal information of its wireless customers, as well as information provided by customers and non-customers who visit the Sites. It also describes the choices available to you regarding our use of your personal information. C Spire™ is owned by Cellular South, Inc.

This Privacy Policy does not apply to other websites, third party application providers or to the Internet generally. C Spire may make content or services from other websites available to you from links located on our Sites. C Spire is not responsible for the privacy, security, or content of such sites. C Spire also uses third parties to advertise its products and services on the Internet and websites owned by parties that are unaffiliated with C Spire. You should review the privacy policy of each application provider you use and at any third party web site you visit to determine how that provider or site protects your privacy.

C Spire has been awarded TRUSTe's Privacy Seal signifying that this privacy policy and practices have been reviewed by TRUSTe for compliance with TRUSTe's program requirements including transparency, accountability and choice regarding the collection and use of your personal information. The TRUSTe program does not cover information that may be collected through downloadable software. The TRUSTe program covers only information that is collected through desktop website (www.cpsire.com) and the mobile website (www.cspire.com/mobile).

INFORMATION COLLECTION AND USE

We may collect the following personal information from you:

  • Information we receive from customers through use of C Spire wireless service. If you are a wireless customer of C Spire Wireless, we collect certain information by and through your use of the wireless services we provide. This may include basic subscriber information such as your name, address and mobile number, as well as call detail information such as numbers contacted by you, location information and other information used to provide wireless service to you. We also collect information related to the use and location of your device and our network, applications downloaded to your device, amounts of data used, volume, length, type and duration of mobile service use (e.g., SMS, voice, picture messaging, etc.), visits to C Spire stores, contact with customer care, service history, billing history, device history, and your use of our website, applications and other products and services. We also may collect additional information when you give us permission to do so, like the websites you visit (URLs) while using our wireless service.
  • Information you provide through of your use of the Sites. Whether you are a C Spire customer or not, when you use our Sites, we collect information concerning your use of our website, applications and other products and services. We also automatically collect general log data information, like your IP address, your interactions with the Sites and with third-party sites, and your geographic region. We also may collect demographic information such as age, education, gender, and ZIP code. In addition, your participation in certain personalized offerings on the Sites may lead to C Spire's collection of information from you; however, C Spire will inform you in the terms and conditions of such offerings prior to your agreement to participate in same, and provide you the ability to opt-out of our collection and use of such information.
  • Personally identifiable information. Personally Identifiable Information is information that could be used to determine your identity (e.g., your name or email address). When you log in to the Sites, you will create a login in which we may ask for your email address, password and mobile number.
  • Information you choose to provide. At times, we may offer you an opportunity to provide additional information to further personalize your services. If you choose to do so, you may choose to complete a profile and/or provide us additional information regarding your interests and preferences.
  • Information from third-party services you link to the Sites. You may choose to visit certain C Spire properties available on third party social media sites, and in certain instances you may have the opportunity to link your third party profile to your C Spire login. If you choose to do so, you give C Spire permission to authenticate your identity, access and use your information from that third party service to the extent permitted by that service. These services may give you the option to post information about your participation in the Sites to your profile page to share with others within your network.
  • Location Data. If you have enabled the location data detector on your mobile device, we may, with your permission, collect location information from your mobile device. This information is encrypted in a secure format during transmission. You can disable certain sharing of your location data by turning this feature off on your mobile device. In addition, please note that you may be asked by third party application providers to provide them access to your location data. You should carefully review the terms and conditions applicable to such applications and the privacy policies of any third-parties to whom you provide your consent to use location information, because when you use such third-party services their terms of use and privacy policies will govern.
  • Miscellaneous. We obtain address information about you from third party sources, such as the US Postal Service, to verify your address so we can properly ship your order to you and to prevent fraud. Sometimes we purchase marketing data about our customers from third parties and combine it with information we already have about you to create more tailored advertising and products. We may obtain credit information about you from an outside credit reporting agency to help us with customer authentication and credit-related decisions.

C Spire does not design its Websites to attract, nor do we knowingly collect personal information from children under thirteen (13) years of age. Ordering online products and services from C Spire is limited to adults (eighteen (18) years of age or older or as otherwise legally defined).

We use this information to:

  • Fulfill your order and send order confirmation
  • Provide you personalized services and experiences on our Sites
  • To administer and maintain accounts, including rewards program accounts
  • Send you information regarding our products and services
  • Respond to customer service issues
  • To send you marketing communications about our services or the products or services of third parties, whether via regular mail, email, or SMS text
  • Administer contests and sweepstakes you have entered, and notify you if you won
  • Respond to questions and concerns
  • Improve our company and marketing efforts
  • Conduct research and analysis
  • Display content based on your interests and/or location
  • Facilitate communication with other users of our Sites

INFORMATION SHARING

We will share your personal information with third parties in the ways that are described in this privacy statement. We will never sell your personal information to third parties.

  • Service Providers. We may provide your personal information to companies that provide services to help us with our business activities such as shipping your order, offering customer service and analysis, and/or providing software platforms for the Sites. These companies are authorized to use your personal information only as necessary to provide these services to us.
  • Legal Disclaimer. We may also disclose your personal information as required by law, such as to comply with a subpoena, or similar legal process; when we believe in good faith that disclosure is necessary to protect our rights, protect your safety, or the safety of others, investigate fraud or respond to government request; or if we are involved in a merger, acquisition, or sale of all or a portion of our assets, you will be notified of any change in ownership or uses of your personal information, as well as any choices you have regarding your personal information.
  • To any other third party with your prior consent.

USER ACCESS AND CHOICE

C Spire prides itself on providing you a personalized experience. But we understand that participating in personalization is your choice to make. That is why we have created a Your Preference Profile, so you may view your choices about how we may contact you. If you are a customer of C Spire and the Account Holder, then you can manage the privacy preferences of each mobile number on your account. If you are not the Account Holder on the C Spire account, you may have the ability to manage certain preferences subject to modification by the Account Holder.

You may request that we stop collection and delete certain information by sending an email with such request to askus@cspire.com; however, please note that we have legal obligations to retain certain information, and must retain certain information necessary for us to provide our customers services. CPNI

Section 222 of the Telecommunications Act of 1996, as amended (the "Telecommunications Act") establishes certain criteria regarding the use of certain telephone customer information that we collect from our customers solely by virtue of the customer-carrier relationship, such as quantity, technical configuration, type, destination, location and amount of use of the telecommunications services you receive, as well as billing information. The Telecommunications Act refers to this type of information as "customer proprietary network information," or CPNI. C Spire will disclose and/or use CPNI only as permitted by the Telecommunications Act and applicable rules and regulations. We may periodically contact you regarding promotions, offers, products or services from C Spire, its affiliates, and/or third parties via email, SMS text message and/or other methods. TRACKING TECHNOLOGIES/COOKIES

APP ARCADE CONTEST

OFFICIAL CONTEST RULES & REGULATIONS

THE FOLLOWING CONTEST IS INTENDED FOR LEGAL RESIDENTS OF THE UNITED STATES AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT PROCEED WITH THIS CONTEST IF YOU ARE NOT A LEGAL RESIDENT OF THE UNITED STATES.

C Spire (hereinafter referred to as "C Spire") will conduct the "App Arcade Contest" (hereinafter referred to as the "Contest") beginning September 27th, 2011, and ending December 30th, 2011 (hereinafter referred to as the "Contest Period"), unless sooner terminated by C Spire, at its discretion.

ELIGIBILITY:  Contest is open to legal residents of the United States, and who are 18 years of age or older (19 years of age or older for residents of Alabama) as of the date of entry. Minors are ineligible to participate in the Contest. Winners must possess a valid driver's license. The period for participation in the Contest is the Contest Period. Employees, contingent staff persons, officers and directors, together with relatives (parents, grandparents, children, grandchildren, siblings and spouses of each) and/or those living in the same households, of C Spire and their respective parents, subsidiaries and affiliates are ineligible to participate in the Contest or win any Contest prize. The term "immediate families" includes spouses, grandparents, parents, siblings, children, and grandchildren.

PARTICIPATION.  The Contest is offered electronically via the Internet. All persons who meet the eligibility requirements and who participate in the C Spire App Arcade game during the relevant period are automatically entered into the Contest. Entries and entrants must meet all the terms and conditions of these Official Rules and must be received by C Spire no later than 11:59 p.m. CT on the last day of the applicable Contest Period.

PRIZES. There will be regular drawings, approximately one per day (each hereinafter referred to as a "Draw"), during the Contest Period with the eligible participant selected in each Draw receiving a variable cash or non-cash prize determined by C Spire in its sole discretion (hereinafter referred to as the "Prize") for an approximate aggregate value of $30,000 USD in Prizes to be given away during the Contest Period. Each Prize will be awarded once and will only be awarded in the form of wireless device, accessory, or travel prize. There will be no substitutions for prizes. Prizes awarded are non-transferable. Winners will be notified within a reasonable time after the relevant Draw. Failure to collect a prize within thirty (30) days of notification of award constitutes forfeiture of the Prize. If forfeited, the Prize will remain the property of C Spire. Another winner will not be selected.

NO PURCHASE NECESSARY.  No purchase is necessary to enter or win. Eligible persons may receive one (1) entry by legibly printing their name, street address, city, state, postal code, telephone number and complete email address, on a 3 x 5 inch (or 7.5 x 12.5 cm) piece of paper and mailing it to Marketing / C Spire App Arcade, 1018 Highland Colony Parkway, Suite 340, Ridgeland, MS  39157. All entries become the exclusive property of C Spire and will not be acknowledged or returned.

CHANGE OF ADDRESS POLICY.  It is the sole responsibility of the entrant to notify C Spire in writing if the entrant changes his/her address, email address, and/or telephone number. RELEASE AND AUTHORIZATION.  By participating in the Contest entrants release C Spire and its parent company, affiliates, subsidiaries, advertising / promotional agencies, and the employees, officers, directors and agents of any of the above organizations from any and all liability for any claims, injuries, losses, or damages of any kind caused by participation in the Contest or the acceptance, possession or use/misuse of a prize or participation in any prize-related activities. Where legal, by accepting a prize the winner grants C Spire permission to use his/her name, address, likeness, photograph, Contest submission, and statements in advertising and for other promotional or publicity purposes without further compensation.
